Can Foreigners Buy Property in Ras Al Khaimah? Freehold Areas Guide 2026
A source-backed guide to foreign ownership, RAK freehold areas, registration, buying costs and the checks to complete before reserving a property.
What “freehold” means for a foreign buyer
Freehold ownership generally means the registered owner holds the property without a fixed lease expiry, subject to UAE and Ras Al Khaimah law, the title documentation and the rules of the development. It is different from a long lease or usufruct right, which grants use for a defined period or under specific conditions.
The label used in marketing is not enough. Ask for the title or initial-registration evidence, project approval, plot details and written confirmation that the proposed buyer can register the selected property. For a company purchase, trust arrangement, succession plan or joint ownership, obtain independent UAE legal advice before signing.
RAK freehold areas listed by the authority
RAK Municipality’s real-estate sale service currently names the following freehold locations:
- Al Marjan Island — waterfront apartments, branded residences, hospitality and development opportunities.
- Mina Al Arab — waterfront communities with apartments, villas and mixed-use projects.
- Al Hamra Village — an established coastal community with apartments, townhouses and villas.
- RAK Central — a developing business and mixed-use district.
- Julphar Towers — residential and commercial ownership opportunities.
- Al Maareedh — specified plots; confirm the precise plot status.
- Beach District — identified by the authority as an upcoming freehold area.
This is an authority-level area list, not a guarantee that every property inside a named location is immediately transferable to every buyer. Unit-level verification remains essential.
Can a non-resident buy?
Foreign ownership in an eligible RAK freehold property does not generally depend on already holding UAE residency. A non-resident buyer must still pass identity and compliance checks, use acceptable signing and payment channels, and provide the documents required by the developer, seller, bank and registration authority.
International buyers may be able to complete parts of the transaction remotely or through a properly drafted power of attorney. Confirm the accepted process for the exact transaction before arranging notarisation, legalisation or travel.
How the buying process works
1. Confirm eligibility. Verify the area, project, unit and proposed ownership name in writing.
2. Check the seller or developer. For off-plan purchases, verify the developer, project registration and escrow or guarantee account with RERA-RAK. For resale, verify the seller, title, outstanding balance, tenancy position and NOC requirements.
3. Review the contract. Check the area, view, price, payment milestones, completion, default provisions, assignment rights, service charges, furnishing and management terms.
4. Pay through verified channels. Match every payment instruction to the official contract and approved account. Avoid unrelated personal accounts.
5. Register the transaction. Complete the required buyer-and-seller documentation and registration through RAK Municipality’s Lands and Properties Sector or the applicable approved channel.
Registration costs and total budget
RAK Municipality’s sale-registration service currently lists a fee equal to 2% of market value from the buyer and 2% from the seller, together with listed plan and title-deed charges where applicable. Confirm the current invoice for the transaction because fees and allocation can change.
Your cash budget may also need to cover agency fees, conveyancing or legal review, mortgage valuation and registration, bank charges, currency transfer, insurance, furnishing, service charges and property management. For off-plan property, model every instalment rather than focusing only on the reservation amount.
Golden Visa: ownership is not automatic approval
Buying a qualifying property may support a UAE Golden Residency application, but a title deed does not itself guarantee immigration approval. The Federal Authority for Identity, Citizenship, Customs and Port Security currently publishes a property-investor route with an AED 2 million threshold, subject to its current evidence and eligibility rules. Confirm the latest requirements directly with ICP or an authorised adviser before treating residency as part of the investment case.
Seven checks before paying a reservation
Confirm: (1) the exact ownership right; (2) the buyer name or company structure; (3) developer and project registration; (4) escrow details for off-plan property; (5) unit area, view and specifications; (6) full acquisition and ownership costs; and (7) cancellation, default, assignment and completion terms. A strong opportunity should survive document-level scrutiny.
