Can Foreigners Buy Property in Dubai? Freehold Areas Guide 2026

A source-backed guide to where international buyers may own Dubai property, the difference between freehold and limited rights, current registration costs and the checks to complete before paying.

Direct answerYes. Dubai law permits non-UAE nationals to acquire freehold ownership without time restriction in areas designated by the Ruler of Dubai. Foreign buyers may also acquire usufruct or leasehold rights for periods of up to 99 years in designated areas. Eligibility must be confirmed for the exact plot, unit and ownership structure.

What freehold ownership means

Freehold ownership gives the registered owner an indefinite real-property interest, subject to Dubai law, the title deed, community rules and any registered restrictions. For an apartment, ownership is normally registered together with the applicable share in the jointly owned property. A title deed issued by the Dubai Land Department is the decisive record—not a developer brochure or portal label.

Leasehold and usufruct are different. They grant possession or use for a defined period and under stated conditions. Before comparing prices, establish precisely which legal right is being transferred.

Where can foreigners buy in Dubai?

Regulation No. 3 of 2006 identified designated areas and plots where non-UAE nationals may acquire property rights, and later resolutions have added further land. In market practice, widely recognised freehold communities include Downtown Dubai, Business Bay, Dubai Marina, Jumeirah Beach Residence, Palm Jumeirah, Emirates Hills, Dubai Hills Estate, Dubai Creek Harbour, Jumeirah Village Circle, Jumeirah Lake Towers, Dubai Sports City, Motor City, International City, Dubai Silicon Oasis, Dubai Production City, Dubai South and selected plots in other districts.

This community list is orientation—not a substitute for title-level verification. Boundaries, plot numbers and the legal character of a specific asset matter. Ask the seller or developer for current title or initial-registration evidence and confirm it through DLD or an authorised trustee.

Can a non-resident purchase?

Prior UAE residency is not generally required for an eligible freehold purchase. Non-resident buyers must still satisfy identity, source-of-funds, sanctions and compliance checks, use approved payment channels and complete the required signatures and registration. Mortgage availability and loan-to-value may differ for residents and non-residents.

Remote completion may be possible depending on the property, bank and parties. If a power of attorney is required, confirm the exact wording, notarisation and legalisation requirements before issuing it.

Dubai purchase process

1. Verify the property and ownership right. Check the title deed or Oqood record, seller identity, permitted ownership and outstanding obligations.

2. Agree the commercial terms. Record the price, deposit, transfer date, vacant-possession or tenancy position, NOC responsibility, default terms and included items.

3. Review documents. For resale, examine title, Form F or SPA, NOC, service-charge clearance, mortgage position and tenancy documents. For off-plan, verify the project, developer, escrow account, payment schedule and SPA.

4. Pay through verified channels. Match beneficiary details to official documentation. Off-plan funds should follow the approved project escrow process.

5. Register the transfer. Complete the DLD or authorised trustee procedure and obtain the updated title evidence.

DLD fees and total buying costs

DLD’s property sale registration service currently lists 2% of the sale value from the seller and 2% from the buyer. Transactions commonly describe this as the 4% DLD fee, but the commercial contract may state who will bear which amounts. The service also lists title-deed, map, knowledge, innovation and registration-trustee charges.

Budget separately for brokerage, conveyancing or legal review, NOC charges, mortgage valuation and registration, bank fees, currency conversion, service charges, insurance and property-management costs. Request a transaction-specific completion statement instead of relying on a generic percentage.

Off-plan verification

DLD states that off-plan developers receiving purchaser funds must use a project escrow account. Buyers can use DLD services and the Dubai REST application to review project information, including completion and escrow details. Confirm that the advertisement, developer, project and payment account are authorised before transferring funds.

Golden Visa is a separate decision

Owning Dubai property does not automatically grant residency. Property-investor residence and Golden Residency routes have their own current valuation, ownership, financing and document requirements. Confirm the applicable route with DLD and the relevant immigration authority before treating a visa as part of the investment return.
